Defensive Publication or Disclosure

A defensive publication is used to save the cost of filling and maintaining a patent and at the same time strategically hinder other parties from obtaining a patent for the disclosed invention. A defensive publication publically discloses an enabling description and/or drawing of the invention so that it becomes prior art. Writing a defensive publication or disclosure requires a thorough understanding of the invention and knowledge of the technical area. The skill of the person writing such a document has a direct bearing on the intended purpose, that is, the disclosure must prevent any future attempt to work around the idea and patent a related invention. Moreover, the disclosure must anticipate and/or make obvious a competitor’s future patent application. Our team has drafted several defensive publication disclosures. Our team is equipped with business-centric intelligence that enables you to take informed decisions to pursue an application for patent or publish it as a defensive publication
